11.28.020 Fire Prevention Division

        A.    The Fire Prevention Division (FPD) is hereby established within the city fire and rescue department and is charged with enforcing requirements imposed on the city relating to fire prevention activities by the HFC, the HMC or intergovernmental agreement.

        B.    The fire marshal is in charge of the FPD and will be designated by the fire chief and approved by the manager and may be removed by the same.

        C.    The fire marshal may, with the concurrence of the fire chief and manager, select and appoint additional deputies and assistants as deemed necessary to fulfill the requirements imposed on the Division by the HFC, the HMC and intergovernmental agreement.

        D.    In addition to the authority granted the fire marshal by the HFC, the HMC or intergovernmental agreement, the fire marshal and the deputies and assistants thereof are authorized to seek compliance and, if necessary, bring actions for compliance through orders issued pursuant to this provision, citations issued pursuant to HMC 11.28.040 and/or actions for compliance pursuant to HMC 4.04.

        i.      If the fire marshal, or deputies, upon an examination or inspection finds a building or structure which for want of proper repairs, maintenance, unlawful modification or any other cause or reason, is especially liable to fire, and which is so situated or occupied as to endanger other buildings or property or human life, shall order the building to be repaired and all dangerous conditions remedied.

        ii.     If the fire marshal, or deputies, finds any building or structure in a condition of any kind to be, dangerous to the safety of the building or premises or human life, shall order such conditions to removed or remedied.

        iii.    The order shall be made against and served personally or by registered letter upon the owner, lessee or occupant of the building or premises. Thereupon it shall be complied with by the owner, lessee, agent or occupant within the time fixed in the order. Upon failure to comply, the fire marshal may close the building or premises for any use or occupancy until compliance has been made. Such order shall be posted at or upon each entrance or exit of the building in substantially the following form:

        E.     The fire marshal has authority to adopt written rules relating to and amending the provisions adopted by HMC 11.28.010 when necessary to properly discharge the assigned functions under the HFC or intergovernmental agreement.

        F.     The fire marshal has authority to issue written interpretations of the HFC in the event it is either necessary or appropriate to promote public safety.

        G.    The fire marshal may require certain activities deemed to pose a heightened risk of danger from fire or explosion to first obtain a permit and pay an application fee as set by council resolution.

        H.    The fire marshal will identify in writing not later than January 31st of each year which activities are believed to pose a heightened risk of danger from fire or explosion and provide that list to the fire chief and manager.
